Terms of Service
These terms are the agreement between WG Realm, trading as RESTREAMER 24/7, Hong Kong SAR ("we", "us", "RESTREAMER 24/7") and the person or business that opens an account ("you", the "Customer"). They apply to the RESTREAMER 24/7 service, the customer portal at portal.restreamer247.com and this website. By ticking the box at sign-up, paying for a plan or using the service you accept them together with the Acceptable Use Policy and the Privacy Policy, which are part of this agreement.
1. What the service is
RESTREAMER 24/7 takes video files that you make available to us (your "Content"), stores a working copy of them on infrastructure we operate, and transmits that Content as a continuous live stream to accounts you hold on third-party streaming platforms (Twitch, YouTube, Kick, Rumble, Facebook — the "Platforms") using stream keys you give us. We are a technical intermediary: we do not choose, edit, curate or publish your Content, we do not hold the Platform accounts it appears on, and we do not sell or monetise it.
2. Your account
- You must be at least 18 years old and able to enter into a binding contract. A business account binds the business.
- The information you give at sign-up — including what you intend to stream — must be accurate and kept up to date. We review it before opening an account and record that review.
- You are responsible for everything done through your account and your stream keys. One stream key may be published by one service at a time; do not use the same key with another service while it is in use here.
- We may refuse or close an account at our discretion before it goes live, with a refund of any unused prepaid term.
3. Your Content stays yours
You keep every right in your Content. You grant us only the non-exclusive licence we need to provide the service: to copy your Content to our servers, keep it there while you are a customer, transcode nothing, and transmit it to the Platform accounts you specify. The licence ends when your Content is removed or your account closes, except for the copies we must keep under section 9.
4. Your promises about the Content
Because we transmit your Content on your instruction, you are the publisher. You represent and warrant, for every file you make available to us, that:
- you own the Content or hold a licence that expressly allows it to be rebroadcast live on each Platform you selected, worldwide, including any music, footage, artwork, game content and third-party material inside it;
- the Content and its broadcast do not infringe any copyright, trademark, right of publicity, privacy right or other right of any person, and are not unlawful in any country where the stream is available;
- the Content complies with each Platform's terms of service and community guidelines, including their rules on rebroadcasting pre-recorded material, music, and disclosure;
- every rights statement you make in the portal (per folder: "my own recordings" or "licensed", with the licence named) is true. We record who made it, when and from which address, and we rely on it.
You must remove Content, or tell us to hold it, as soon as you learn that any of these is no longer true. We may require a rights statement for a folder before it goes to air.
5. Acceptable use
The Acceptable Use Policy lists what may not be streamed or done through the service. It is part of these terms. In short: nothing you do not have the rights to, nothing illegal, nothing that presents recorded material as a live appearance where the Platform forbids it, and no attempts to evade a Platform's enforcement.
6. Notices, holds, strikes and suspension
- Notices. We accept copyright and other complaints at copyright.html. On a notice that lets us identify the material, we will hold the material named (it stops going to air, the rest of your library continues) and tell you what was held and why. You may respond; we will pass your response on where the law provides for it.
- Holds. We may hold any file or folder pending review, for example after a notice, a Platform enforcement action, or when a folder has no rights statement and one is required. A hold is not a finding against you; it is how we act while a question is open.
- Strikes and repeat-infringer policy. A substantiated complaint, a Platform enforcement action for infringing or unlawful Content, or a breach of the Acceptable Use Policy is recorded as a strike against your account. Strikes count for 12 months. One active strike places your Content under review; two active strikes end your account. We may end an account after a single serious breach.
- Suspension. We may suspend transmission at once, without prior notice, when we receive a complaint that appears valid, when a Platform acts against your account, when the law requires it, or when continuing would expose us to liability. You will be told the reason. Suspension for these causes is not a service failure on our part and does not entitle you to a refund.
7. The Platforms are yours to answer to
The Platforms decide what happens on their sites. A muted VOD, a strike, a ban, demonetisation or any other action a Platform takes against your account is between you and the Platform. We do not appeal on your behalf and are not liable for it. If a Platform closes the account we stream to, the service for that Platform ends and no fees are refunded for the term already started.
8. Fees
- Plans are priced per month, per number of Platforms, and billed in advance for the term you choose (monthly, 6 or 12 months). Prices are on the website and in the portal at the time you buy.
- Terms renew automatically at the end of each term at the then-current price unless you cancel before the renewal date. You can cancel any time from the portal; the service continues to the end of the paid term.
- No refunds for a term already started, including when your account is suspended or ended under sections 6 and 7, or when a Platform closes your account. The one exception is section 2.4.
- Payments are processed by Stripe under Stripe's terms; we never see your card. A charge-back for a service delivered is a breach of these terms and ends the account.
- Prices exclude taxes unless stated; where we must collect tax it is added at checkout.
9. Data, logs and retention
- We read your Content from the folder you share with us on Google Drive (read-only) and keep a working copy on our servers. Removing a file from the shared folder removes our copy at the next sync.
- We keep technical logs of what was transmitted, when and to which Platform. Logs are kept for 14 days in normal operation and for as long as needed when a complaint, a strike, a legal request or a suspension concerns your account (a "legal hold").
- Rights statements, notices about your Content, our decisions on them and strikes are kept for the life of the account plus the period the law requires.
- The Privacy Policy explains what personal data we process and why.
10. Our service, without warranty
We work to keep the stream up around the clock, but we do not promise that it will be uninterrupted or error-free, that a Platform will accept it, that it will reach any audience, or that any Platform feature (quality levels, chat, metadata) will work as you expect. The service is provided as is. To the fullest extent the law allows, we disclaim all implied warranties.
11. Liability and indemnity
- To the fullest extent the law allows, our total liability to you for anything arising out of this agreement is limited to the fees you paid for the three months before the event giving rise to the claim. We are not liable for lost revenue, lost audience, lost Platform accounts or any indirect or consequential loss.
- You will indemnify us — pay our losses, costs and reasonable legal fees — for any claim by a third party (including a rights-holder or a Platform) that arises from your Content, your rights statements, or your breach of these terms or the Acceptable Use Policy.
- Nothing in these terms limits liability that cannot be limited by law.
12. Ending the agreement
You may close your account at any time from the portal. We may end this agreement on notice at the end of your paid term for any reason, or at once for a breach of sections 4, 5 or 6, a charge-back, or a legal requirement. On ending, transmission stops, our copy of your Content is deleted within 30 days (subject to section 9), and section 9, 11 and 13 survive.
13. General
- These terms are governed by the laws of the Hong Kong Special Administrative Region; the courts of Hong Kong have exclusive jurisdiction, without prejudice to mandatory consumer rights where you live.
- We may change these terms. Material changes are announced in the portal or by email at least 14 days before they apply; continuing to use the service after that date is acceptance. A change you do not accept lets you cancel with a refund of the unused term.
- If a part of these terms is unenforceable the rest stays in force. Our failure to enforce a term is not a waiver. You may not assign the agreement; we may assign it to a successor of the business.
- Platform names are trademarks of their owners. We are not affiliated with any Platform.
